A prenuptial or premarital agreement, otherwise known as a prenup, is a contract entered into by the couple before marriage. The agreement enables a couple to control many of the required legal rights that they acquire upon marriage. The written prenup will supersede default marriage laws such as property division, retirement benefits, savings, spousal support, and any pre-existing debts.
A Thai Prenuptial Agreement is governed by the Thai Civil and Commercial Code. It is recommended that you seek advice from your home country and Thai lawyer before entering into a prenup agreement or into marriage to mitigate your financial risks in the future.
The Thai Civil and Commercial Code has several requirements to make a Thai Prenuptial Agreement; they are as follows:

The contract must be in writing.

Each party must receive individual legal counsel.

You must sign the Thai Prenuptial Agreement in the presence of two witnesses before the marriage registration.

You must register the Thai Prenuptial Agreement at the district office local to where the couple registers their marriage.
